The following Terms of Service is a legal agreement between you, or your employer, or other entity on whose behalf you are entering into this agreement ("you" or "Client") and Catfish Camp, and sets forth the rights and obligations with respect to any content licensed by you.
This license defines precisely how, where, and when the image will be used.
Any usage not expressly defined in the license is retained by the copyright holder,
Patrick Woods d/b/a Catfish Camp.
You cannot sublicense, transfer, distribute or gift the image or image rights to any
third party – the licensed image can only be used by the person who purchased the
license.
The only exceptions are:
- Employer or client. If you are purchasing on behalf of your employer or client, then your employer or client can use the content. In that case, you represent and warrant that you have full legal authority to bind your employer or client to the terms of this agreement. If you do not have that authority, then your employer or client may not use the content.
- Subcontractors. You may allow subcontractors (for example, your printer, mailing
house, or web designer) or distributors to use content in any production or
distribution process related to your final project or end use. These subcontractors
and distributors may not use the content for any other purpose.
Licensee cannot use the image, or any part of the image, as part of a trademark,
service mark, logo, etc. – you cannot register copyrighted images as your property.
When used for editorial purposes, Catfishcamp.com / © Patrick Woods must be
credited.
Warrants & Liability: Patrick Woods d/b/a Catfish Camp warrants that all of the
photographs on the website: Catfishcamp.com were created by him and he has the sole authority to license their use to Client. Client will defend Photographer against any and all claims, liability, damages, and costs, including legal fees & expenses, arising out of the creation, use, or misuse of the images. Unless delivered to Client by Photographer, no Model or Property release exists. Client shall pay Photographer’s costs and expenses (including Photographer’s reasonable attorney’s fees and related costs) incurred in connection with enforcing the terms of this Agreement, including those incurred without commencing a court proceeding.
Unless you purchase a specific license, you may not use content in connection with any goods or services intended for resale or distribution where the primary value lies in the content itself including, without limitation, cards, stationery items, paper products, calendars, apparel items, posters (printed on paper, canvas, or any other media), DVDs, mobile applications or other items for resale, license or other distribution for profit. This includes "on demand" products (meaning products in which content is selected by a third party for customization on such product on a made-to-order basis), including, without limitation, postcards, mugs, t-shirts, posters and other items.
Unless you purchase a specific license, you may not use content in electronic or
digital templates intended for resale or other distribution (for example, website
templates, business card templates, electronic greeting card templates, brochure
design templates).
No rights are granted until payment is received in full.
